My daughters' father haven't been around much of their lives. I live in New Hampshire. He lives in Maryland. Now he's trying to get a parenting plan going. The girls have always lived with me. If this thing goes through, can he take my girls out of state to live with him?Can a parent take a child out of state?
He cannot just take them out of state without a parenting plan. However, to avoid court both parents have to come to an agreement about a visitation schedule. If you have an attorney consult with them. Otherwise consider a court mediator. I know my local courthouse has one since he is the one my ex husband an I worked with when modifying our parenting plan.
If he is wanting to take an active role in their lives and he is on their birth certificates and or pays any child support you will have to work with him. If you can request supervised visits then start out with that. Since you have been the primary custodial parent chances are he will not get custody to take them out of state. More likely he'll be granted extended visits probably after a trial period.
I know it is hard to imagine your girls being away from you over night. I struggled with it with all three of my kids immensely. Two years later all three of my kids are adjusted to the schedule. They enjoy their time with me and time with dad. My most important goal is to see my kids happy which is what I have achieved.Can a parent take a child out of state?
No he cant just take her without your written consent its seen as kidnapping.
My friend has to do the same thing with her ex she has to get written permission even to take them on vaca
Its best to go to famil court i feel and have everything written out by law so he cant do anything.
He can't take them to live with him without your consent - he can't actually take them anywhere without your consent because you're the custodial parent.

Yes he can take them with your consent. But he can't take them out of the country without your consent.
