Does Child Support Payments Lower If You Have More Kids From A Different Parent?

My husband pays child support on his 2 daughters from his previous marriage now we have a month old son and with all the bills and rent and his child support its hard to buy diapers and formulas and clothes for our son, Would his child support payments lower if the judge knew how much another child is struggling?Does Child Support Payments Lower If You Have More Kids From A Different Parent?
Child support payments are based on a percentage of his income, the fact that he chose to have another child he can't afford is unfortunate for all of the children. But if in fact you are struggling, his only recourse would be to file a motion for Modification of Child Support. If approved by a judge, it would reduce his monthly payments or they may just deny the reduction and tell him to get a second job.Does Child Support Payments Lower If You Have More Kids From A Different Parent?
child support does not care about any kids except the ones that make them money they are all criminals and i wish they would all go to hell

Depends on the state and the judge, my best friend's husband has two kids by his first wife and pays support. Nothing changed when they had their baby last year. The courts usually just say you're responsible for your children, if he can't afford three kids then he shouldn't have had three kids. You say your child is struggling, well if he lowers his payments it's possible his other kids will suffer as well.
Not likely.


In the eyes of the court,his major obligation is to his first children. The fact that he had another child makes no difference in the amount he pays to them. Why should they do with less because he chose to have another child. This is how the majority of courts will feel.
They don't give a crap how much your child is struggling!


But if his wage is still the same as when they set the child support to begin with and he had another child he can ask for a modification. This will lower it cause circumstances have changed.
Nope state statutory formula for child support is based solely on the income, expenses are irrelevant
